The procedure for requesting an extension of stay is basically identical to filing a new petition but not as much documentation is required for the extension. Extension requests may be filed up to six months in advance of the employee’s current expiration date.
Extension of Status
Extensions of stay can be requested for up to a maximum of three years, but there is no minimum amount of time that the H-1B authorization must be extended.
